Terms of Service

Welcome to Sour: Quit Added Sugar (“Sour”, “we”, “us”, or “our”), a habit-tracking app to help you reduce added sugar, operated by Bartolomeo Steccanella. These Terms of Service (“Terms”) govern your use of the Sour mobile application and the website at getsour.app (together, the “Service”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use Sour, and at least 16 years old in the EU/EEA (or the minimum age required in your country, if higher). By using the Service you confirm that you meet this requirement.

The Service may not be available in all countries, and you are responsible for complying with the laws that apply where you use it. You may not use the Service if you are barred from doing so under applicable law or are located in a country subject to relevant trade embargoes.

2. Your account

Some features require an account, created via magic link (email) or Google Sign-In. You agree to provide accurate information and to keep your email account and any linked Google account secure. You are responsible for activity that occurs under your account. Notify us at hello@getsour.app if you suspect unauthorised use.

3. Subscriptions and payments

Sour offers paid subscriptions (“Sour Premium”) that unlock additional features. Subscription plans, prices, durations, and included features are shown in the app at the point of purchase before you confirm.

  • Billing: Subscriptions are billed through your Apple App Store or Google Play account. We do not receive or store your payment card details.
  • Auto-renewal: Subscriptions renew automatically. Your account will be charged for renewal within 24 hours before the end of the current period, at the price and interval for your plan, unless you cancel before then.
  • Free trials: If your plan includes a free trial, it converts to a paid subscription automatically at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • How to cancel: Manage or cancel your subscription through your Apple ID → Subscriptions (iOS) or Google Play → Subscriptions (Android) settings — not inside the Sour app. If you cancel, you keep access until the end of the current paid period.
  • Refunds: Refunds are handled by Apple or Google under their respective policies, not by us. Submit refund requests through the App Store or Google Play.

4. Medical and wellness disclaimer

Sour provides general wellness information and a habit-tracking tool. It is not medical advice, and it is not a substitute for professional medical care.

Calorie estimates and sugar guidelines in the app are approximations based on what you enter and may not be accurate for your individual circumstances. Consult a qualified healthcare provider before changing your diet, especially if you have diabetes, an eating disorder, a metabolic or other medical condition, take medication, or are pregnant or nursing. Never disregard or delay seeking professional medical advice because of something in the app. If you think you may have a medical emergency, contact your doctor or emergency services.

5. AI output disclaimer

Sour may use AI to estimate the sugar and nutritional content of foods you describe or photograph. AI-generated estimates may be incomplete or inaccurate. They are provided for general guidance only, and you are responsible for verifying any information before relying on it, particularly for health or dietary decisions. The AI feature sends your submitted food text or images to a third-party provider for processing, as described in our Privacy Policy.

6. Acceptable use

You agree to use the Service in good faith and lawfully. You must not:

  • scrape, harvest, or systematically extract data from the Service;
  • reverse engineer, decompile, or attempt to derive source code, except where permitted by law;
  • access the Service through automated means (bots, scripts) without our permission;
  • interfere with, disrupt, or overload the Service or its security features; or
  • use the Service for any unlawful, abusive, or fraudulent purpose.

7. Your content

You retain ownership of the content you create in the app, such as custom food entries, saved foods, notes, and reasons-to-quit. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, and display that content solely to operate and provide the Service to you.

You confirm that you have the rights to any content you enter and that it does not infringe the rights of others or break the law. We will not use your private health information for promotional purposes without your explicit consent.

8. Intellectual property

The Sour name, the Lemo mascot, our logos, designs, software, text, and other content are owned by Bartolomeo Steccanella or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our written permission.

9. Termination

You may stop using the Service and delete your account at any time via Settings → Delete account. We may suspend or terminate your access if you breach these Terms or applicable law, or to protect the Service or other users, with or without notice where appropriate.

On termination, your right to use the Service ends. We will handle your data as described in our Privacy Policy, including deleting your personal data within the stated timeframe. Sections that by their nature should survive termination (including disclaimers, limitation of liability, IP, and governing law) continue to apply.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that estimates or results will be accurate or meet your expectations. Results vary from person to person. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including, for UK consumers, your statutory rights).

11. Limitation of liability

To the maximum extent permitted by law, Bartolomeo Steccanella and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising from or related to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total aggregate liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) GBP £50.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

12. Apple App Store terms

These terms apply if you download Sour from the Apple App Store. You and we acknowledge that these Terms are between you and Bartolomeo Steccanella only, not with Apple, and that Apple is not responsible for the Service or its content.

  • Your licence to use Sour on Apple devices is non-transferable and limited to use on Apple-branded devices you own or control, under Apple’s Usage Rules.
  • Apple has no obligation to provide maintenance or support for the Service.
  • Apple is not responsible for any product warranties, claims that the Service fails to conform to legal or regulatory requirements, product liability claims, or third-party claims that the Service infringes intellectual property rights. Any such claims are governed by these Terms and handled by us.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties, and you will comply with applicable U.S. and other export control laws.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights you have in your country of residence, the courts of England and Wales will have jurisdiction over disputes, and you and we submit to that jurisdiction.

If you are a consumer resident in the EU/EEA or elsewhere, you may also be entitled to bring proceedings in your local courts and to the protection of mandatory provisions of your local law.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you in the app and/or by email and update the “Last updated” date above. Your continued use of the Service after the changes take effect means you accept the updated Terms.
